Estoppel by Deed point succeeds at Privy Council


Charles Gomez and Co represented the successful appellant in the Privy Council appeal 0028/2013 Prime Sight Ltd v E Lavarello. The case dealt with important issues relating to freedom of contract. The Privy Council in London effectively approved established Australian precedent to the effect that parties to a transaction may choose to enter into it on the basis that certain facts are to be treated as correct between themselves, although both know that they are contrary to the true state of affairs in which case the necessary convention for Estoppel will be established.
